Terms and Conditions

  1. The Program is only available to residents of Dufferin County (excluding Melancthon) who reside in residential detached homes, attached homes, townhouses and mobile homes on a permanent foundation.
  2. The Participant represents and warrants that such party has due authority and right over the address in Dufferin County to authorise enrollment in the Program and receive home energy retrofit advice and other benefits that the Participant may be eligible for under the Program.
  3. The Participant agrees and acknowledges that home energy retrofit advisory services will be provided by a third party on behalf of Dufferin County (Dufferin County’s Program Delivery Contractor). Dufferin County’s Program Delivery Contractor may offer or refer the Participant to third party vendors and contractors for energy audits, products, and services. The Participant agrees and acknowledges that the Participant is under no obligation to complete any home energy retrofits based on its participation in the Program, until the Participant enters into a Property Owner Agreement with Dufferin County. The Participant shall assume all responsibility and liability for any home retrofits completed.
  4. The Participant agrees and acknowledges that financing of home energy retrofits may be available through the Program. Should the Participant choose to finance any home energy retrofits through the Program, the Participant shall be solely responsible for repayment of any loans to Dufferin County. 

    The Participant authorizes Dufferin County to collect, use and disclose the Participant’s and house information collected for purposes of the Program and providing services to the Participant, including sharing information with Dufferin County’s Program Delivery Contractor and Program partners. The Participant agrees to provide Dufferin County with the Participant’s EnerGuide for Houses Renovation Upgrade Report (pre retrofit report) and the Participant’s Homeowner Information Sheet (post audit report).

    Participant information disclosed to Dufferin County’s Program Delivery Contractor and Program partners may include contact details, building type, age of home, fuel source, and records showing energy use and consumption for the period beginning three years before the date hereof and ending on the date that is three years after the installation of the Measures

    All Personal Information collected for this Program will be handled in accordance with the Dufferin County Privacy Statement and the Municipal Freedom of Information and Protection of Privacy Act.
  5. The Participant agrees to participate in any follow up surveys, studies, audits, evaluations or verifications conducted by Dufferin County or its delivery contractors in connection with the Program.
  6. The Participant agrees and acknowledges that: (i) Dufferin County, its Program Delivery Contractor, and its Program partners do not make any representation or warranty as to the fitness for use of any such advice, products, or services for their intended purpose or otherwise provided under the Program; (ii) the energy cost savings and other benefits described in connection with the Program are based on estimates, and actual results may differ; (iii) Dufferin County does not provide any guarantee on the amount of energy cost savings and other benefits that the Participant may generate because of any home energy retrofits; (iv) Dufferin County does not provide any warranty over the work performed by the Participant, the Participant’s contractor, and by other third party vendor that the Participant may be referred to through the Program, relating to the advice and services provided under the Program; and, (v) Dufferin County does not provide any guarantee on the amount of rebates or incentives the Participant may receive by completing home energy retrofits and Dufferin County is only providing advice about potential rebates and incentives that the Participant may be eligible to receive (which may not be an exhaustive list of all rebates and incentives available to the Participant).
  7. The Participant shall hereby fully, irrevocably and forever release, acquit and discharge Dufferin County, its Program Delivery Contractors, Program partners and their respective successors, assigns, heirs, administrators, elected and appointed officials, officers, representatives, employees, servants, and agents, without qualification or limitation, from and against any and all claims, manner of actions, causes of actions, suits, losses, debts, dues, accounts, covenants, contracts, damages, costs, interest, damages, liabilities, applications, directives, third party claims or actions of any nature or kind that the Participant had, now has or may hereafter have, whether presently known or unknown, matured or unmatured, arising out of, relating to, or resulting from the Program and any services and benefits provided by Dufferin County under the Program. Dufferin County will not be liable for any direct, indirect, special or consequential damages, costs or losses arising from the advice provided or any home energy retrofits completed, whether in accordance with the manufacturer’s instructions or otherwise, or from any actions, negligence or misconduct by any Dufferin County Program Delivery Contractor or Program partner.
  8. The Program benefits and services are subject to availability of funds in the Program, and the Program may be terminated or discontinued at any time by Dufferin County, in its sole discretion, and without further notice. Dufferin County shall not be responsible for any costs, losses, or damages incurred by the Participant arising out of, related to, or resulting from the termination or discontinuation of the Program.
